NOTICE OF PROPOSED RULE MAKING – SECTION 36A CIVIL AVIATION ACT ADOPTION OF TWO NEW ZELAND CIVIL AVIATION RULE PARTS RELATING TO REMOTELY PILOTED AIRCRAFT SYSTEMS / DRONES: PART 101 & 102 TO BE KNOWN AS: VANUATU CIVIL AVIATION RULE PART 101 and 102 I, Jotham Napat, Minister of Infrastructure and Public Utilities, with responsibility for civil aviation, am proposing to make the following Rules: Vanuatu Civil Aviation Rule (VCAR): Part 101 Gyrogliders and Parasails, Unmanned Aircraft (including Balloons), Kites, and Rockets – Operating Rules Vanuatu Civil Aviation Rule (VCAR): Part 102 Unmanned Aircraft Operator Certification Content of Rule Incorporated by Reference In accordance with section 36A of the Civil Aviation Act 1999 this Rule Part, incorporates by way of reference, the Rules contained in New Zealand Civil Aviation Rule Part 101 and 102 in force as at 1 July 2018 as modified hereunder and shall be read subject to an Adoption and Interpretation Statement. Objective of the Rule The purpose of Part 101 is to prescribe the operating rules for persons operating: • unmanned aircraft, including; o moored balloons o free balloons o remotely piloted aircraft o control line model aircraft o free flight model aircraft • kites • rockets • gyrogliders • parasails. The purpose of Part 102 is to set the requirements for the certification and operation of unmanned aircraft outside of Rule Part 101. The Rules address a current gap in the regulation of remotely piloted aircraft systems (RPAS), also known as ‘drones’, ‘unmanned aircraft/aerial system’ (UAS), ‘remotely piloted aircraft’ (RPA), and ‘unmanned aerial vehicle’ (UAV) and other equivalent terms, by establishing a new rule part to regulate the activity of these aircraft. Vanuatu first adopted Part 101 of the New Zealand Civil Aviation Rules on 21 July 2006. Since this date there have been multiple amendments to the New Zealand rule which have not been adopted in Vanuatu. Significant amendments to Part 101 occurred in August 2015 which were directed at better regulation of RPAS, alongside a new certification rule part for RPAS under Part 102. The proposed adoption of Rules is intended to ensure that the rule remains fit for purpose and up to date. The issues underpinning, and policy objectives of, the amendments to the Rule is set out in the Notice of Proposed Rule Making (NPRM) issued in New Zealand in December 2014.
